Terms and Conditions
Please take time to read our terms and conditions before ordering any Gift Vouchers, and do not hesitate to contact us on any point requiring clarification. These terms and conditions govern the contract under which Into the Blue will supply Gift Vouchers to you. When the user of the Gift Voucher books an activity with an operator they will enter into a separate contract with the operator for the supply of the activity in question and become subject to the operator's own terms and conditions
Within 365 days of purchase we will be happy to exchange the Gift Voucher for any activity featured on our website at no extra charge. Exchanges cannot be made if the activity has already been booked with the supplier. Gift Tins/boxes can only be returned if all contents are present and the plastic wallets are intact. If the chosen alternative is more expensive you will have to pay the difference. If the chosen alternative is less expensive we will hold that amount in credit for you to use against a future purchase. Please note that all promotional codes are for new online orders only and cannot be used in conjunction with an exchange or token redemption. When a discount code has been used for the original purchase, the value of the credit will be based on the amount paid, not on the pre-discounted value of the voucher.
No guarantee can be made as to availability of the activity on any particular day. We advise that the user books as soon as possible before the preferred date.
Many activities have height, weight and age restrictions. We can advise you of these restrictions when you purchase a Gift Voucher. If the user is 18 or under the consent of a parent/guardian will be required. Other age limits may apply.
Some driving activities require the user to hold a full driving licence. Please check before purchasing a Gift Voucher.
Our prices may be changed at any time. We will advise you of any such changes when you order a Gift voucher.
Gift vouchers are despatched by first class Royal Mail. We will not be liable for any cost or loss or inconvenience suffered due to delayed or lost mail.
Most Gift Vouchers are valid for 12 months from the date of purchase and may be revalidated prior to the expiry date for a further 12 months on payment of a £20 admin fee and any price increase that may have taken place during the lifetime of the voucher. We are unable to extend vouchers once they have expired. Revalidation can only take place once. Many activities are seasonal; details of availability may be viewed online when you register your voucher. It is the responsibility of the voucher holder to ensure that the activity is booked within season bearing in mind that this may end before the expiry date of the voucher. Some Vouchers that are sold on special offer have a shorter lifespan and these vouchers usually have to be booked and taken within the period of validity. These Vouchers usually cannot be extended.
The contract between you and Into the Blue does not create any right enforceable by any person under the Contracts (Rights of Third Parties) Act 1999, but this does not affect any right or remedy of a third party which exists or is available apart from under that Act.
Into the Blue endeavour to give accurate and detailed information about every activity. However there may be changes in the exact arrangements on the day or during the course of the 12 months lifetime of the voucher. These descriptions should therefore be taken as a guide only and do not form part of the contract. Photographs used are illustrative and not necessarily of the actual equipment in use at any particular location. In the event of an element of a course not being completed and no satisfactory alternatives being supplied the maximum compensation available is limited to the net cost of the element not completed.
Voucher Registration
Vouchers bought on or after 04/04/2012 must be registered online. On registration you will be given the necessary information to make your booking directly with the supplier of the experience.
Into the blue
Are not operators of aircraft nor providers of carriage by air. Neither are Into the Blue operators of any other vehicle or equipment used in the provision of the activities sold. We are unable to give any guarantee as to the safety standards or performance of any operator. The operator may require a disclaimer to be signed before the activity.
We cannot accept any responsibility for any loss howsoever arising from our contract with you for the supply of Gift Vouchers (save in the case of death or personal injury caused by our negligence).
Liability for any delay or cancellation of the activity or loss, injury, death or any other claim howsoever arising from or howsoever caused by the activities advertised on our website or ordered through us shall be the sole responsibility of the operator who provides the activities and shall be governed by that operators terms and conditions.
Cancellation
Waiting time may be necessary with all activities, especially as some are weather dependant. There is also the possibility of short notice cancellation due to weather, mechanical problems, staff illness or other unforeseen circumstances beyond the operators control. If the activity is cancelled the user should simply re-book with the operator concerned. Into the Blue will not be liable for any costs such as travel or accommodation incurred by the participant in such circumstances.
Once the user has booked his chosen activity they will become subject to the operators terms and conditions including the operators cancellation terms. This may mean that if the user cancels a booking the user may forfeit the activity.
Should an activity become unavailable or a particular location become unavailable for any reason whatsoever after you have received your voucher we will endeavour to find an acceptable alternative activity at the same price. Failing this we reserve the right to give a full refund. This will be made to the purchaser of the voucher. This will be the limit of our liability and we will not be liable for any other costs incurred by the participant such as travel or accommodation.
The user will need to be agile enough to get in and out of the particular aircraft or equipment in use and must be medically fit enough for the particular activity. If the user has any doubts about medical fitness, they should consult their doctor.
Lowest Price Guarantee
If you find the identical product on sale from another multi-experience provider at a lower price within seven days of your purchase date, (excluding sales, special offers, time and date bookings and other promotions), we will refund you 150% of the difference, up to a maximum value of £50.
Refunds/Complaints
The easiest way of resolving a complaint is to address them on the day. If your complaint cannot be resolved on the day please inform us by writing to our Customer Services Manager.
You can claim a refund up to 30 days after placing an order with Into the Blue unless the activity date and time has been booked with the supplier. The request for a refund must be made in writing within thirty calendar days and delivered or sent to our offices (email is acceptable). Refunds after this period will be at our discretion and will be subject to a £20 or 20% (whichever is greater) fee. Note that refunds can only be made to the purchaser. Refunds will not be made to the user or any third party.
Insurance/Safety
Many of our activities involve some personal risk. In purchasing one of our activity gift vouchers you accept the existence of an element of risk. Life insurance policies vary in their coverage, and some may exclude certain of the activities Into the Blue offer. It is advisable to check this with your insurance company in advance.
The operators for the various activities advertised normally arrange their own liability insurance which will provide insurance for participants in the case of negligence on behalf of that operator.
Indemnity/Damage Waiver/Cancellation Insurance
Some driving operators require customers to complete an Indemnity/Damage waiver form on the day of the experience. This may state that the driver will be liable for a fixed amount of costs should they damage the vehicle whilst driving. Most of these suppliers are able to provide Indemnity/Damage Waiver insurance at a small additional fee (usually £20-£25) payable on site. Some suppliers also offer Cancellation Insurance. The purchase of these insurances is optional and is in additional to the Public Liability Insurance held by all venues. The full details of any indemnity, damage waiver or cancellation insurance will be provided by the activity operator. Into the Blue are unable to advise or comment on the content or suitability of these products.
Discounts and Promotions
On occasions Into The Blue run time limited discounts and promotions. We reserve the right to limit the use of these codes to certain products, price ranges and times. Most discounts and promotion codes have limitations to the products and sometimes we are unable to display the full terms of the discount on smaller advertisements. Most discount codes have a lower spend limit of £25 and an upper spend limit of £200, you will be advised in the basket page if the code you are applying is applicable to your purchase. Some prices and offers are subject to change and we reserve the right to change these offers for any reason. Most discount codes are only applicable to one item in your shopping basket and not against multiple items in your basket. Free post and packing codes and special delivery codes are applicable on your order and do cover multiple items. When a promotion is offered for packaging upgrades for multiple items this must include multiple line items in your basket and not one line item for multiple people. When a discount code has been used for the original purchase, the value of the credit will be based on the amount paid, not on the pre-discounted value of the voucher. Special Delivery promotion codes for free 'Weekday Special Delivery' despatched on a Friday will go on 'weekday special delivery' which will guarantee delivery by the following Monday. For a Saturday Guaranteed delivery you must select 'Saturday Special Delivery' option at the checkout and will not be able to use the 'Weekday Special Delivery' promotion code.
Evouchers
You can select your vouchers to be sent to you by email immediately after purchase. On the basket page, you can do this by selecting the Evoucher packaging option. This option is completely free of charge. By doing so, you will receive your voucher instantly after payment is complete. You can then register your voucher immediately and make your booking with the relevant venue. We advise that you print and take a copy of the evoucher with you on the day of your experience. Please note that when you chose the evoucher option we won't send you out a physical voucher. Should you need a physical voucher to give out as gift for instance, then you need to select the relevant packaging. If you find that you need a physical gift after placing an evoucher order, then please email sales@intotheblue.co.uk. Please note that admin charges apply then.
Distance Estimates on web pages
Whilst Into The Blue uses all reasonable efforts to ensure that the distances published on this website are accurate, no warranties are made as to the accuracy of such information. Distance estimates are ‘as the crow flies’ rather than actual road distances. Into The Blue cannot accept any responsibility for losses arising directly or indirectly from the use of the distance estimation feature because we rely on third party data to make these distance estimates and assumptions on locations. To avoid inconvenience and disappointment you need to double check all distances when initially contacting the venue to book your experience day and allow sufficient time to arrive at the venue from your departure point.
